What Is Form W-8BEN?

Form W-8BEN is an IRS form a non-US individual gives to a US payer to certify they are a foreign person and, where a tax treaty applies, claim a reduced US withholding rate. It tells the payer you are not a US taxpayer.

How Form W-8BEN works

When a US business pays a foreign individual certain types of US-source income, it may have to withhold tax at a default 30% rate.

You complete Form W-8BEN to certify your foreign status and your country of residence, and to claim treaty benefits that can lower or remove that withholding. You give it to the US payer or withholding agent — you do not file it with the IRS — and it generally stays valid until the end of the third calendar year after signing, unless your details change.
